A Rochester appeals court has rejected Greenidge Generation’s request to delay administrative actions by the Department of Environmental Conservation (DEC) regarding its air permit. According to The Finger Lakes Times, the Fourth Judicial Department denied the company’s motion to halt the DEC’s review while Greenidge appeals a previous court ruling.
Greenidge had argued that the DEC’s decision to deny its permit renewal in 2022 was flawed. Though a judge found errors in the denial, the ruling allowed the DEC to restart its review. The appeals court, however, declined to grant a stay, allowing the process to move forward.
Greenidge President Dale Irwin criticized the ruling, arguing that the DEC lacks authority to reject the permit renewal. Environmental groups involved in the case did not comment on the decision.
