Two arrested after $11,500 gift card fraud at Waterloo gas station

Two individuals were arrested Sunday night after allegedly using a fraudulent debit card to purchase $11,500 in gift cards at a Speedway gas station in Waterloo.

New York State Police responded to the Speedway at 703 Waterloo Geneva Road at approximately 6:33 p.m. for a larceny report. Employees told troopers that the suspects had already fled the scene in a white Ford Expedition after making the fraudulent purchases.

A BOLO (Be On the Lookout) alert was issued to surrounding counties. Hours later, at approximately 10:35 p.m., troopers spotted a white Ford Expedition matching the suspect vehicle’s description traveling on State Route 5 & 20 in Ontario County. A traffic stop was conducted, leading to the identification of the driver, Marrion M. Simms, 28, a Michigan resident with multiple extraditable warrants from Ohio, Missouri, and Pennsylvania. The passenger was identified as Deshon L. Davis, 24, of Rochester.

Troopers confirmed Simms and Davis were the suspects involved in the Speedway incident. Both were taken into custody and transported to the New York State Police barracks in Waterloo for processing.

Simms was charged with grand larceny in the third degree (D felony), conspiracy in the fifth degree (A misdemeanor), and fugitive from justice charges related to his out-of-state warrants. Davis was charged with grand larceny in the third degree and conspiracy in the fifth degree.

Both suspects were remanded to the Seneca County Jail, pending centralized arraignment on Monday morning.
