Seneca Meadows Inc. plans to appeal to New York’s highest court after an appellate ruling reinstated Local Law 3-2016, which mandates the landfill’s closure by December 31, 2025.
The Rochester-based Appellate Division ruled 3-2 that SMI lacked standing to challenge the law based on environmental grounds. Despite presenting evidence, the court found no proof of environmental harm. Neighboring property owner Dixie Lemmon and Concerned Citizens of Seneca County initially appealed the lower court’s decision to invalidate the law.
SMI is also pursuing approval from the Department of Environmental Conservation to expand the landfill, potentially keeping it operational until 2040. Public hearings will follow once the environmental impact statement is finalized.
