Couple Sues New York, Chemung County Over Beloved Squirrel’s Euthanasia

An Elmira couple has filed a lawsuit against New York State, Chemung County, and multiple agencies, claiming the seizure and euthanasia of their squirrel, Peanut, and a raccoon named Fred were illegal. The animals, owned by Mark Longo and Daniela Bittner, were taken from their Pine City animal sanctuary, P’Nut’s Freedom Farm, on Oct. 30. The Department of Environmental Conservation (DEC) said rabies concerns prompted the animals’ euthanasia, but the couple disputes this, calling it an abuse of power.


Peanut, an unreleasable squirrel rescued seven years ago, gained widespread social media fame, amassing over a million followers. The couple argues the animals were euthanized without proper authorization or due process, violating their rights. They also claim Peanut’s unique appeal supported their sanctuary and entertainment ventures financially.

The lawsuit seeks damages for the animals’ deaths and alleged mishandling of the case. Further legal action is expected.
