Spencerport man arrested for assaulting Bath sergeant; department speaks out about violence against police

A Spencerport man was arrested after injuring a sergeant in Bath.

David C. Cervantes, 38, faces a second-degree assault charge, a class D felony. The incident occurred on Howell Street when police were assisting Bath Ambulance with a medical call. Cervantes became non-compliant and struck the sergeant, kicking them in the head.

Cervantes was found under the influence of meth and taken to Ira Davenport Hospital. He was later processed at Bath Police Department and arraigned at Steuben County Jail. The injured sergeant received medical treatment for head trauma.

The department issued the following statement on Facebook:

“Two officer assaults last week in our agency. A kick to the head and a punch to the face. Both officers were injured and missed work. Assaults and resisting arrest charges against police also need to be prosecuted to the fullest extent of the law. A minor resisting arrest can quite quickly go horribly wrong and shouldn’t just be viewed as part of our job.”
