The Appellate Division of the Fourth Judicial Department has overturned a 2023 decision, allowing the Cayuga Nation to file a late claim for $59,400 seized from a Nation business.
The ruling permits the Nation to file the claim within 30 days. The money was taken by police during a confrontation at a Seneca Falls gas station on January 1, 2022, after the Cayuga Nation evicted former operators Dustin Parker and Nora Weber.
The Cayuga Nation argued that the money, taken by town police, should have been returned to them. The appellate court agreed, stating the Nation should have been allowed to file a late claim due to the circumstances.
