Cannabis attorney hopeful that David Tulley will be able to obtain cannabis license after legal case is settled

Joseph A. Bondy, a cannabis attorney from New York City, is formulating a legal defense for David Tulley, the proprietor of several unlicensed cannabis dispensaries in the Finger Lakes, which were mandated to cease operations by authorities earlier this summer.


Bondy spoke at length with The Auburn Citizen who hopes that once the case is concluded, Tulley can apply for cannabis business licenses on an equal footing with other contenders, rather than reopening the currently closed I’m Stuck dispensaries.


This comes after Bondy’s motion to dismiss the New York State Office of Cannabis Management’s injunction against Tulley’s dispensaries was rejected on Sept. 6.

The dispensary chain, including locations in Cayuga, Wayne, and Monroe counties, experienced the wrath of strengthened enforcement powers, marking the first instance of state action against such “gray market” businesses.

Bondy is currently requesting the presentation of body wire evidence from the officers who conducted the June raids, hoping it would prove a Fourth Amendment violation and subsequently nullify the acquired evidence in court.
