Driver charged with vehicular assault after impairment leads to Seneca County crash

On Wednesday around 1:30 a.m., deputies from the Seneca County Sheriff’s Office, along with investigators, responded to a significant vehicle accident on State Route 89 in the town of Fayette.


Robert A. Fitzgerald, 38, from Yanceyville, North Carolina, lost control of his 2018 Dodge Caravan, veering off the road and colliding with a utility pole. An inquiry into the crash implicated driver impairment as a key factor.

Fitzgerald’s passenger, a 40-year-old male, suffered severe injuries to his face and head and was rushed to Geneva General Hospital by North Seneca Ambulance.


Following the investigation, Fitzgerald was charged with driving while ability impaired by drugs, vehicular assault, and other traffic violations.

He is now in custody at the Seneca County Correctional Facility, awaiting his hearing at Seneca County CAP Court. The New York State Police provided assistance at the crash site.
