Sheriff Barry Virts reports the arrest of a Red Creek man on an assault charge following an investigation involving Child Protective Services.
Lewis Benjamin, 23, of Red Creek was taken into custody after an investigation was initiated by Wayne County CPS.
Sheriff Virts said in a press release that a complaint was received via the New York State Child Abuse Hotline alleging that in October, Benjamin struck a two year old child.
The child suffered injuries as result of the incident. Benjamin was charged with second-degree assault and endangering the welfare of a child.
Investigators further alleged that the incident occurred when Benjamin became upset with the child and struck her with an open hand. There was significant bruising, swelling, and pain as result of the attack.
enjamin was arrested and brought to the Wayne County Jail for CAPS arraignment. He is scheduled to appear in the local court at a later date and time to answer to the charges.
