A federal judge has ruled that religious institutions can have the same 50% indoor capacity as restaurants and businesses.
Governor Andrew Cuomo had previously limited gatherings to 25% in Phase 3, then increased it to 33% for regions that entered Phase 4.
However, District Judge Gary Sharpe said certain COVID restrictions enforced by the Governor favored protest over prayer. He also ruled that a state cannot enforce any capacity limit on outdoor religious services.
The Governor has not spoken out publicly about the decision.
