Family from Penn Yan threatens another lawsuit over religious exemption battle involving autistic child

The 11-year-old boy with severe autism whose medical vaccine exemption was denied earlier this year was denied once again.

This year, for the first time, Thorn Schwartz had his medical exemption from vaccines denied, so Thorn has been barred from his school for more than a month.

News10NBC learned he and his family got more bad news.

Carl Schwartz, Thorn’s dad, said they re-applied for a medical exemption and got denied by Monroe One BOCES in Fairport again last week. BOCES said it’s following new state guidelines.



Schwartz, who is a lawyer, said he’s preparing to sue the state again.

In June, the New York State Legislature and Governor Andrew Cuomo repealed the religious exemption for vaccines.

In September, Thorn was barred from his school over vaccines.

From his home in Penn Yan, Schwartz says his son isn’t doing well.
