State Supreme Court Judge John Ark has ruled that a solar farm on Gates Road should not be assessed and subject to local property taxes.
The Town Board will likely vote to appeal that ruling when it meets tonight.
Supervisor Andrew Wickham said the the town will ask the Marcus Whitman school district and Ontario County to join in the appeal. The $200,000 assessed value assigned to the 15.5-acre solar panel farm owned by Argos Solar LLC generates property taxes for the county and school district.
The town does not have a general or highway tax because of revenue it receives from hosting from the Ontario County Landfill.
Argos sells the electricity generated by the solar panels to Cornell University to be applied to its electric bill for Cornell AgriTech, formerly the New York State Agricultural Experiment Station in Geneva.
