Avoca man charged with felony DWI after young child found in vehicle

A late-night traffic stop in Bath led to felony driving while intoxicated charges after police found a young child in the vehicle.

Joshua A. Bollinger, 33, of Avoca, was arrested following the stop on East Washington Street.


An officer with the Village of Bath Police Department conducted the traffic stop around 11:50 p.m. on Feb. 21 after observing a violation of New York’s Vehicle and Traffic Law.

Police said Bollinger showed multiple signs of impairment during the investigation. Officers determined he was impaired and took him into custody.

Authorities also reported that a 1.5-year-old child was in the vehicle at the time.

Bollinger was charged with aggravated DWI with a child passenger under 15, a Class E felony, and driving while ability impaired by drugs, also a Class E felony.

He was also charged with consuming cannabis in a motor vehicle and failure to signal prior to 100 feet of a turn, both violations.

Police processed Bollinger and transported him to the Steuben County Jail for CAP arraignment, where he was released.
