The Town of Victor Planning Board continued its ongoing review of a proposed Chick-fil-A restaurant near Eastview Mall during its meeting last week. The session also included a vote on an art gallery site plan, discussion of a historic home demolition, and several agenda items postponed to future dates.
Chick-fil-A site plan remains under review
Representatives from CHA Companies returned to the board with updated materials on behalf of Eastview Mall LLC for a proposed Chick-fil-A restaurant at 100–1020 Eastview Mall Drive. The project, under review for several meetings, involves the construction of a 5,331-square-foot quick-service restaurant featuring a double-lane drive-thru and outdoor patio on a 1.96-acre section at the southeast corner of the mall property.
Project representatives noted that no variances were needed and that coordination with the New York State Department of Transportation regarding traffic impacts was ongoing. Buffering, lighting, and landscaping plans were confirmed to comply with town code.
During the public hearing, two residents voiced concerns about anticipated traffic congestion. One speaker remarked, “This drive is already heavily used, especially during holidays, and this will only increase backups.”
Board Chair Joe Logan said the hearing would remain open to allow time for further public comment and submission of any revisions at a future meeting.
Art gallery approved at 7404 State Route 96
The board unanimously approved a site plan application from 3 Bears Properties LLC to convert an existing building into an art gallery. The proposal includes a 280-square-foot addition and a partial demolition of an attached garage to make room for a second-story deck.
Logan called the proposal “a straightforward adaptive reuse,” and there were no public comments on the application. The hearing was closed before the board granted approval with standard conditions.
Demolition request approved for historic Modock Road home
Colin Blind, owner of 7432 Modock Road, appeared before the board seeking approval to demolish a residential structure that is over 50 years old and listed with medium significance on the Town of Victor Historical Resource Inventory. The property is zoned residential and requires Planning Board review under Town Code 211-50.1 before demolition may proceed.
Blind described the structure as unsafe, citing foundation damage and significant rot. He said he plans to build a new home on the site.
“The house is not safe to live in,” Blind said.
Board Chair Logan emphasized the Planning Board’s role was only to review whether demolition could proceed—not to approve any future construction.
The board voted to recommend demolition without conditions. Board member Jason Kester voted against the motion.
Dog salon proposal presented
An application from Bow Wow Dog Salon to operate a dog grooming and kennel facility at 7235 State Route 96 was presented. The project would include 43 kennels, grooming areas, office space, and a fenced outdoor run.
Board members raised questions about noise control, air circulation, and animal waste disposal. The applicant confirmed soundproofing and ventilation measures would be used.
The board kept the public hearing open to allow for further information and a possible site visit.
Several items deferred
Multiple applications were removed from the agenda and postponed to later meetings, including:
- Cheshire Ridge subdivision (02-PS-2025, 02-FS-2025)
- Lehigh Place PDD subdivision and site plan (03-PS-2025, 03-FS-2025, 31-SP-2025)
- Stewart Tree Service site plan (06-SU-2025, 21-SP-2025)
- Timberview Estate subdivision (01-PS-2025).
Proposed zoning changes introduced
Two proposed local laws were introduced for board discussion. The first would create a new Commercial Center (CC) zoning district. The second would amend the zoning map to designate Eastview Mall within that new district. These items were introduced without action and will return for further discussion in the future.
