Despite acknowledging his mistaken deportation, officials argue they lack authority to act—an assertion the court flatly rejected.
The court upheld a lower judge’s order demanding sworn testimony from key officials, warning that continued resistance erodes the rule of law. Judges, including a Reagan appointee, said detaining a U.S. resident abroad without due process endangers fundamental liberties.
While the administration labels Abrego Garcia a gang member, no criminal charges exist. The court insists due process must be honored—regardless of the government’s claims.
