Deputies arrested a Victory man Friday after finding him in a vehicle at Cato Elementary School with a woman protected by a full stay-away order of protection, according to the Cayuga County Sheriff’s Office.

Charles H. Kirk, 43, was charged with Criminal Contempt in the 2nd Degree, a misdemeanor.

Sheriff Brian Schenck said deputies were first dispatched around 3:58 p.m. on April 4 to a possible domestic violence call in the Town of Victory. During their investigation, they learned that the individuals involved were at the Cato Elementary School during student dismissal.

Responding to the school, deputies found Kirk in the passenger seat of a car in the pickup line. The driver, a woman, was the protected party in a full stay-away order of protection issued by the court.

Deputies arrested Kirk at the scene and took him to the Cayuga County Public Safety Building for processing. He was later remanded to the county jail in lieu of $10,000 cash bail or $20,000 bond. Kirk is scheduled to appear in the Town of Ira Court on April 14 at 5 p.m.
