The Village of Newark’s Zoning Board of Appeals (ZBA) and Planning Board will hold separate meetings in October to review several project proposals seeking variances from local zoning regulations.
The ZBA will convene on October 16 at 6:30 p.m. in the Village Court Room, located on the second floor of the Newark Municipal Building. The session will begin with a workshop at 6:00 p.m. followed by the approval of minutes from the previous meeting​.
One of the key items on the ZBA agenda is a request from Edward Marsteiner, who is seeking to modify a previously approved area variance for his property at 257 Grace Avenue. Marsteiner is requesting to amend the variance to allow for the placement of an 8-foot by 12-foot non-permanent shed seven feet from the front yard setback on Lucia Street. The current zoning law requires a setback of at least 25 feet for corner lots in residential zones​.
Another significant project on the ZBA’s docket involves John Ott of Indus Hospitality Group, who is requesting multiple variances for a property located at 434 East Union Street. Ott is seeking approval for two attached wall signs—one on the south side and one on the west side—exceeding the maximum allowable signage. The total signage requested amounts to 208 square feet, well above the permitted 125 square feet for wall signage. Ott also seeks permission for a 60-square-foot freestanding sign, which would be nearly double the allowed size of 32 square feet. Additionally, he is asking for approval to install three freestanding directional signs on the property, even though zoning regulations limit the number of freestanding signs to one​​.
On October 7, 2024, the Newark Planning Board will also meet to review the same proposal from Ott and address a similar request for area variances. The Planning Board session will take place at 6:30 p.m., preceded by a workshop at 6:00 p.m. Both meetings are open to the public​.
Also on the Planning Board’s agenda is a request from Tyler Schumann, who is seeking a variance to allow a 14-foot by 27-foot addition to his home at 122 Pine Ridge Drive. Schumann’s proposal requires reducing the side yard setback from 10 feet to 8 feet, a deviation from the village’s residential zoning requirements​.
Both meetings will be held at the Newark Municipal Building, located at 100 East Miller Street, Newark, New York.
