Canandaigua man charged with vehicular assault: Had BAC four-times legal limit

The Ontario County Sheriff’s Office arrested a Canandaigua man following an investigation into a serious crash on Brace Road last December.

On December 9 in the town of Canandaigua Nicholas Albert, 28, was operating a vehicle on Brace Road. It was determined that he was intoxicated with a BAC more than four-times the legal limit.


As result of the crash a passenger sustained serious injuries.

He’s been charged with three counts of DWI as well as first-degree vehicular assault. Deputies said Albert was found to have a BAC of 0.32% and had drugs in his system at the time of the crash too.

He was arraigned and released to appear in local court at a later date.
