Waterloo Container Co.’s legal counsel alleges that Seneca Meadows Inc. (SMI) is infringing upon a 2007 host community agreement with Seneca Falls.
The Finger Lakes Times reports the dispute arises from SMI’s application to expand its Route 414 landfill without establishing a new or revised agreement.
Attorney Doug Zamelis, representing Waterloo Container, highlighted that SMI’s move to grow the landfill facility violates sub-paragraph IV of the 2007 accord.
This clause explicitly restricts Seneca Meadows from pursuing any expansion post-2025 without inking a fresh or amended community agreement.
He demands that the town board enforce the stipulation and threatened legal action if compliance isn’t ensured by September 30, 2023.
Zamelis further noted that during a town board meeting on August 1, details emerged indicating SMI’s intent for a permit to amplify the landfill’s height by approximately 70 feet. This development comes as the Department of Environmental Conservation (DEC) is currently evaluating an Environmental Impact Statement (EIS) from SMI to ensure it covers all environmental concerns.
