The owners of a Rochester-area pizza shop chain are now facing a 78-count indictment for failing to pay sales tax.
Carmelo and Rosanna Calascibetta are accused of charges including offering a false instrument for filing, criminal tax fraud, and grand larceny.
Prosecutors say the crimes happened between 2011 and 2015 and the failure was uncovered in an audit by the Department of Taxation and Finance when officials noticed a discrepancy between federal and state tax returns for the pizza shop owners.
Monroe County Assistant District Attorney Michael Bezer says the Calascibettas also failed to report some sales. As a result, the couple failed to pay $400,000 worth of sales tax to the state.
The Calascibettas appeared in court Tuesday morning on the indictment.
