New York Attorney General Letitia James has released drone footage from the investigation into the death of Freddie Marty Jr., who was fatally shot during an encounter with Onondaga County sheriff's deputies in Elbridge.
Marty died Aug. 23 at the Rolling Hills Mobile Home Park after deputies responded to a report that someone had fired a gun at a parked car, according to the attorney general's office.
Deputies arrived shortly before 6 p.m. and attempted to speak with Marty, who was inside a mobile home, the office said. Around 11:30 p.m., deputies broke a window and used a drone to look inside the home.
The attorney general's office said Marty allegedly raised a long gun and pointed it at deputies. One deputy then fired a service weapon and struck Marty.
Marty was pronounced dead at the scene. Authorities recovered a long gun there, according to the office.
The Office of Special Investigation, a division of the attorney general's office, obtained the drone footage during its ongoing review and released it to the public. The agency warned that the video contains material viewers may find disturbing.
James has directed the office to release camera footage obtained during special investigations as part of an effort to increase transparency and public trust. The release itself does not state a conclusion about whether any person committed a crime or should face charges.
Under Section 70-b of New York's Executive Law, the Office of Special Investigation assesses reports in which a police officer, peace officer or corrections officer may have caused a person's death through an action or failure to act. The law applies whether the officer was on or off duty and whether the person who died was armed, unarmed, in custody or outside custody.
If the initial assessment indicates that an officer may have caused the death, the office conducts a full investigation. The attorney general's office said its investigation into Marty's death remains ongoing.
