The New York Attorney General’s Office has opened an investigation into the death of a pedestrian who was struck by an off-duty Westchester County correction officer in Orange County.
The collision happened shortly before 10:30 p.m. Aug. 31 on State Route 32 in Cornwall, according to the attorney general’s Office of Special Investigation.
Investigators said the off-duty officer was turning right onto Quaker Avenue when the officer’s vehicle struck the pedestrian.
The pedestrian was taken to a local hospital and died from the injuries Sept. 5. The state release did not identify the pedestrian or the officer.
The Office of Special Investigation reviews incidents in which a police officer or peace officer may have caused a person’s death through an act or omission. State law covers officers who are on duty or off duty and incidents involving people who are either in or outside custody.
If the office’s initial assessment finds that an officer may have caused a death, it proceeds with a full investigation.
The attorney general’s office said the facts released Tuesday are preliminary and could change as the investigation continues.
