The Penn Yan Village Board approved a litigation settlement tied to a Yates County Industrial Development Agency annexation petition during a special meeting Monday.
The board also granted a waiver of the 30-day advance notice requirement for Osteria Allora LLC, a new Italian restaurant planned for 138 Water St.
The special meeting was held at 5 p.m. June 22 at Village Hall. Mayor Patricia Christensen and Trustees Teresa Hoban, Brenda Travis, Ronald Dailey, Robert Craig and Dan Henries were present. Trustee Kevin McLoud was absent.
The board voted 6-0 to approve Resolution 47-2026 granting the waiver for Osteria Allora to seek a liquor, wine, beer and cider license. Village Attorney Ed Brockman explained the 500-foot exemption for municipalities with fewer than 20,000 residents, according to the meeting minutes.
Officials said the restaurant will open at the former Union Block location.
The board then entered executive session at 5:06 p.m. to discuss current litigation involving the annexation of property at 2442 Old Route 14A. The property is identified as Tax Map No. 61.01-1-6.11.
After returning from executive session, the board voted 5-0 to authorize Resolution 46-2026 regarding settlement of litigation concerning the Yates County IDA petition to annex territory from the town of Milo into the village of Penn Yan. Christensen abstained from that vote, and McLoud was absent.
Henries thanked the mayor for what he described as her full recusal from the annexation matter. Hoban commented on the time lost during the process, while Travis said officials would continue to be vigilant.
Lauren Snyder said it was wonderful that the matter had come to a resolution, while another resident raised concerns about the potential impact on taxes and utilities, according to the minutes.
