A late-night assault investigation in Bath resulted in felony charges against a local man accused of striking another resident with a hammer, according to the Village of Bath Police Department.
David Hively, 62, of Bath, was arrested after officers responded to a Belfast Street residence around 11:42 p.m. on June 1 for a report of an assault involving a hammer. Upon arrival, officers found a victim with injuries to his mouth that were consistent with being struck by the tool.
Police said the suspect was located at the residence and identified as Hively, who also lives at the home. Following an investigation, officers took him into custody.
Hively was charged with second-degree assault and third-degree criminal possession of a weapon, both Class D felonies.
Police said Hively was transported to the Steuben County Jail, where he was held due to his criminal history and status as a three-time convicted felon.
