A harassment complaint in Penn Yan led to charges that an intimate image was shared without consent.
Xavia D. Miller, 26, of Dundee, and Daniel J. Smith, 39, of Penn Yan, were arrested Feb. 15 following a police investigation.
Police said Miller sent a nude image of the victim to another person with the intent to cause emotional harm. Investigators also determined Smith, who is an inmate at the Yates County Jail, conspired with Miller to facilitate the crime.
Both were charged with unlawful dissemination or publication of an intimate image and sixth-degree conspiracy.
Miller was released on an appearance ticket and is scheduled to appear in Penn Yan Village Court at a later date. Smith will be produced in village court for arraignment.
