Months after resigning over a failed breath test, a former Seneca County Sheriff’s Office deputy now faces a new drunken driving charge, according to the Finger Lakes Times.
Deputies arrested 33-year-old Johnathan McNabb early Feb. 9 in Ovid and charged him with misdemeanor DWI and failing to keep right. Officers say they stopped him after he drifted out of his lane.
McNabb resigned last May after a breath test showed a .10 blood-alcohol level while he drove a patrol car. Prosecutors declined charges then, citing a lack of evidence, and he left the department before disciplinary action moved forward.
He now awaits arraignment at the Seneca County Correctional Facility.
