Justice Department fights Sarcone ruling

A legal fight over who runs Albany’s top federal prosecutor’s office just escalated, according to the Times Union. The U.S. Department of Justice moved to fast-track an appeal after a judge ruled John Sarcone III was unlawfully appointed.

The ruling from Lorna G. Schofield tossed two grand jury subpoenas tied to a probe involving Letitia James. Prosecutors argue Sarcone still holds valid authority and say the decision raises major separation-of-powers questions.

The appeal won’t halt the investigation. Prosecutors can reissue subpoenas without Sarcone’s signature, while his 210-day term nears its end.
