Police arrested a man following a report of a sexual assault involving a 15-year-old in the village of Penn Yan.
Penn Yan Police said the investigation determined the suspect allegedly provided alcohol and drugs to the victim before engaging in vaginal and oral sexual contact while the victim was under the influence and incapacitated.
Police identified the suspect as Daniel R. Sims, 34, of Farmington. Officers said Sims is on parole and was taken into custody by New York State Parole Officers before being turned over to Penn Yan Police.
Sims was charged with rape in the first degree, a class B felony; rape in the third degree, a class E felony; and facilitating a sexual performance of a child with drugs or alcohol, a class B felony.
Police transported Sims to the Yates County Jail, where he was held awaiting arraignment in Yates County CAP Court. Penn Yan Police said they were assisted in the investigation by the Child Advocacy Center of the Finger Lakes, the Yates County District Attorney’s Office, and the New York State Department of Corrections and Community Supervision.
