Milo weighs eminent domain fight

A bitter land dispute in Yates County just took a sharper turn, according to the Finger Lakes Times.


The Town of Milo told residents it may use eminent domain to take control of a 72-acre parcel tied up in an annexation battle. The land, owned by the Finger Lakes Economic Development Center, sits in an agricultural zone the town says should stay rural.

The dispute traces back to a failed effort to annex the property into the Penn Yan for mixed-use housing. Milo rejected that plan, and both sides have since filed lawsuits, driving legal costs past $91,000.

Milo scheduled a Feb. 23 public hearing on eminent domain and another Jan. 20 hearing on stricter zoning rules.
