Penn Yan police arrested a Geneva man following an investigation into an alleged sexual assault that occurred in the village.
Police said Bryan Garcia-Perez, 37, was taken into custody after investigators connected him to an incident reported on October 24. Authorities allege the victim was intoxicated or unconscious at the time.
Investigators say Garcia-Perez assaulted the female victim on two separate occasions in the Village of Penn Yan. He was charged with two counts of first-degree sexual abuse, a Class D felony.
Garcia-Perez was arraigned in Yates County CAP Court and released on pre-trial release conditions. He is scheduled to appear in Village of Penn Yan Court at a later date.
The charges are accusations. Garcia-Perez is presumed innocent unless and until proven guilty in court.
