New York opens overtime tax credit applications for farm employers

New York farmers can now apply for reimbursement through the Farm Employer Overtime Credit, a refundable tax program aimed at easing labor costs while supporting the state’s agricultural workforce.

The program allows eligible farm employers to recover a portion of overtime wages paid to workers since January 1. Applications are open through September 30.


“This credit is reducing the tax burden for our farm businesses while helping them to continue supporting their hardworking staff,” the state said in announcing the application period.

The credit applies to direct farm employers and those using Professional Employer Organizations. Approved farms will receive certificates from the Department of Agriculture and Markets and may then claim payment through the Department of Taxation and Finance.

Agriculture Commissioner Richard A. Ball called labor a critical issue for the industry and said the program offers essential relief. “We are working hard to ensure that farmers have the resources they need to support their workforce,” Ball said.
