Victor Planning Board approves fireworks tents, fencing, and pole barn; solar project advances too (video)

The Victor Planning Board met on June 10 to review a series of site plans and special use permit applications, including seasonal fireworks retail tents, residential fencing, an accessory pole barn, and a large-scale solar energy facility. Several larger commercial and residential developments, originally slated for the meeting, were postponed until a future session.

Seasonal Fireworks Tents Receive Approval

The board held public hearings and approved two applications for temporary fireworks sales tents in anticipation of the July 4 holiday.

Keystone Fireworks received approval (04-SU-2025, 18-SP-2025) to set up a 20-by-40-foot tent at 7161 State Route 96. The tent will operate from 9 a.m. to 9 p.m. daily, with extended hours until 10:30 p.m. on July 3 and 4. The applicant also requested and received approval for the setup to continue annually through 2027.

A similar application (05-SU-2025, 19-SP-2025) from TNT Fireworks for a tent at 40 Square Drive was also approved. This operation will run from June 20 to July 5, with daily hours from 9 a.m. to 10 p.m.

Property Improvement Applications Approved

The board granted site plan approval to Carl Herrgesell (16-SP-2025) for a chain link fence installation at 118 Fishers Road. The fence will mark the northern boundary of the property. The applicant noted that the fencing is for property demarcation and will not enclose the full parcel.

Also approved was an application from Michele Warner (17-SP-2025) for the construction of a 2,400-square-foot pole barn at 8018 Taylor Road. The barn will be used for personal storage, with no commercial or business activity proposed.

Norbut Solar Farm Advances

The Planning Board reviewed updated materials for the proposed Norbut Solar Farm (02-SP-2024) on Main Street Fishers. The 4.428 MWAC project spans 34.93 acres of forest and meadowland. Project representatives addressed public questions regarding environmental impacts, stormwater management, noise, and visual screening. The updated plan incorporates revised town solar code requirements, including 100-foot property setbacks and 300-foot residential buffers. No action was taken at this meeting, as the board continues to evaluate final materials.

Larger Projects Delayed to Future Meetings

Three major commercial and residential applications were removed from the June 10 agenda and are expected to return at future meetings:

  • Hoselton Enterprises Site Plan and Change of Use at 7447 State Route 96 for a wholesale/retail auto sales facility.
  • Timberview Estates Subdivision, a 24-lot residential project on Cline Road.
  • Element by Westin Hotel and Chick-fil-A Restaurant, both proposed on Eastview Mall Drive.

Preliminary Review: Nickoloff Subdivision

The board also conducted a preliminary review of the Nickoloff Subdivision (05-PS-2024), a proposal to divide 42.4 acres into seven residential lots with access from Blazey Road. This marks the second phase in the major subdivision review process following the sketch plan acceptance on August 27, 2024.

The meeting began with approval of the May 28 minutes and updates from Town Board member Dave Condon and Planning Board member Keith Maynard II .

Next Meeting

The next scheduled Planning Board meeting will include review of the previously tabled Hoselton Enterprises project, Timberview Estates Subdivision, and the Element by Westin and Chick-fil-A site plans.
