Ahead of President-elect Donald Trump’s second term, Senators Elizabeth Warren (D-Mass.) and Richard Blumenthal (D-Conn.) are pressing the Biden administration to impose limits on domestic military deployments.
Their letter, dated Nov. 26, calls for a policy directive restricting the use of active-duty troops and federalized National Guard forces unless explicitly requested by state or local authorities or in extreme cases of unrest.
The senators raised concerns about Trump’s previous comments suggesting military intervention in deportations, border security, and targeting “enemies from within.” They also highlighted potential abuses of the Insurrection Act, which allows presidential deployment of troops during insurrections or civil unrest, calling it a dangerous loophole in the Posse Comitatus Act.
The senators urged Biden to ensure future presidents consult Congress before using such authority and warned of ambiguity stemming from recent Supreme Court rulings on presidential immunity.
