This follows a temporary halt prompted by a legislative subpoena for Roberson’s testimony regarding his innocence claim.
Roberson’s attorneys argue new medical evidence shows Nikki’s death resulted from undiagnosed pneumonia and sepsis, not shaken baby syndrome.
Critics, including over 80 Texas lawmakers and former case detective Brian Wharton, back his claim of wrongful conviction. The ruling allows a new execution date to be set while maintaining the possibility of Roberson testifying before state lawmakers.
