Geneva residents sue city over sewer damage after flooding

Two Pulteney Street residents have filed a lawsuit against the city of Geneva, alleging poor maintenance of a storm sewer system damaged their properties. The suit was first reported by The Finger Lakes Times on Monday.

Julia Hoyle and her husband, Kelby Russell, claim their properties at 132 and 138 Pulteney St. were flooded due to a breach in the Cemetery Creek Sewer System after heavy rain in April 2023. They allege the city misrepresented the issue, attributing the flooding to gutters and a natural waterway. The couple refused to sign a document making them responsible for future damages.

After further breaches in July 2023, the stormwater, allegedly contaminated with human waste, caused more damage.

The city hasn’t responded yet.
