Biden’s asylum restrictions face legal challenge

President Joe Biden’s executive order limiting asylum claims is facing a legal challenge from the American Civil Liberties Union (ACLU) and immigrant advocacy groups, which could impact his efforts to address border crossings ahead of the November election.

The lawsuit, filed by the ACLU on Wednesday, argues that Biden’s order to impose strict restrictions on granting asylum mirrors a similar order by former President Trump that was overturned by federal courts. The White House insists that Biden’s order is different, but the lawsuit disputes this claim.

Biden’s order, which uses the same legal authority as Trump’s, aims to limit asylum when border encounters exceed 2,500 per day and will remain until numbers fall below 1,500. Exceptions include unaccompanied children and victims of human trafficking. Critics argue the order will not solve immigration issues and emphasize the need for congressional action to address the root problems.
