Seneca Falls man faces obstruction charge after choking person during dispute

Seneca Falls police say a local man was taken into custody less than a week after an alleged physical dispute.

Walter J. Smithoover, 50, of Seneca Falls was arrested by the Seneca Falls Police Department on Sunday at 9:10 a.m. His arrest followed a report of a physical altercation that occurred on April 29, where Smithoover allegedly assaulted another individual.

During the incident, Smithoover is accused of wrapping his arm around the victim’s neck, causing the individual to become unable to breathe and experience dizziness. He has been charged with criminal obstruction of breathing, which is classified as a misdemeanor.

After processing, Smithoover was released on an appearance ticket. He is scheduled to return to court at a later date to respond to the charge.
