Police: Property damage accident leads to DWI arrest in Penn Yan after driver is uncooperative

Police say a property damage accident led to a DWI arrest in the village of Penn Yan over the weekend.

On Friday around 3:30 p.m. police arrested Martin Murphy, 24, for DWI, refusing to submit a breath test, and moving from lane unsafely.

The arrest followed an accident on Wagener Street. While investigating the accident, police observed several indicators of intoxication from Murphy being glossy eyes
and the strong odor of an alcoholic beverage coming from his breath. Police say he refused to perform field sobriety tests and was taken into custody.

Once in custody he refused to submit to a breath test. He was ultimately transported to the Penn Yan Police Department where he was processed for DWI common law.

The charges will be answered at a later date.
