DeVito, serving since 2015, expressed her decision to resign was to seek opportunities better aligned with her future career aspirations. She has denied allegations leveled by The Citizen, and told the outlet that she would not comment further on their investigation.

The newspaper is also involved in a legal dispute over whether a Freedom of Information Law request applies to the organization. The BID contends that it does not need to provide requested communications because it’s not a governmental agency. However, the Committee on Open Government disagrees, noting that since it functions off a partial collection of tax dollars that it therefore applies.
