Albert Smith, a 40-year-old resident of Niagara Falls has been sentenced to 188 months in prison for possession of child pornography involving a prepubescent minor, along with a previous conviction for sexual abuse involving a minor. This sentencing was carried out by U.S. District Judge Lawrence J. Vilardo, as announced by U.S. Attorney Trini E. Ross. Smith’s history includes a 2003 conviction for sexual contact with a person under 14 years old.
During a search of Smith’s residence on October 22, 2021, law enforcement seized two cell phones and discovered additional electronic devices containing 314 images and 25 videos of child pornography. These materials depicted very young minors, including an infant or toddler, and were found despite Smith’s attempt to discard one of the devices.
This case, managed by Assistant U.S. Attorney Maeve E. Huggins, was investigated by the Niagara Falls Police Department and the Federal Bureau of Investigation. Smith’s sentencing underscores the seriousness with which the justice system treats offenses involving the exploitation of children.
