Deputies arrested a Rochester resident in Ontario County after a sick or intoxicated driver complaint at the Taco Bell near the intersection of State Routes 96 and 332.
It happened on December 7, according to deputies, who said they were called there a little before 9 p.m.
Timothy Simmons, 58, is accused of being observed operating his vehicle erratically at the Taco Bell there; and then a short time later was stopped by deputies on Route 332.
He was taken into custody without incident and charged with DWI, as well as consumption of alcohol in a motor vehicle.
The charges will be answered at a later date.
