The Wayne County Sheriff’s Office has reported the arrest of David M. Diguardi, a 56-year-old resident of Penn Yan, following a motor vehicle collision in the town of Ontario.
The incident occurred when Diguardi, traveling east on Paddy Lane, veered off the roadway and collided with a parked vehicle.
An investigation by deputies at the scene led to the determination that Diguardi was operating his vehicle under the influence of alcohol.
Following the collision and initial assessment, Diguardi was taken into custody and transported to the Wayne County Sheriff’s Office.
He voluntarily underwent a chemical test, which revealed his blood alcohol content (BAC) to be .08%. Based on these findings and his driving record, Diguardi was charged with multiple offenses, including DWI as a felony, given his previous DWI conviction within the past ten years.
In addition to the felony DWI charge, Diguardi faces several other counts, including DWI with a BAC of .08% or greater, aggravated unlicensed operation, moving from lane unsafely, and operating without a seatbelt.
The charges will be answered at a later date.
