Lawsuit claims Port Byron schools failed to halt repeated abuse of special needs child

A lawsuit has been filed against the Port Byron Central School District and Cayuga-Onondaga BOCES, alleging that they neglected to prevent the sexual abuse of a special needs student on two occasions by another student.

The Auburn Citizen reported on the lawsuit, which was filed in February in Cayuga County Supreme Court.


The lawsuit accuses the district and BOCES of “woefully inadequate and negligent supervision,” allowing the abuse to occur first when the child was 5 and then again at 13, despite prior requests to separate the two students.

The lawsuit also alleges that the child has suffered severe emotional, psychological, and physical harm due to the defendants’ negligence.
