A Cayuga County Court Judge, Thomas Leone, confirmed the legitimacy of the second indictment against Auburn murder suspect, Gage Ashley, 26, on Friday.
Ashley was initially convicted for the November 2019 shooting of Joshua A. Poole but saw his convictions overruled in May due to an improperly formed grand jury. He was indicted again in June on various charges, including first-degree murder, with his trial set for early March 2024.
The defense, led by Ashley’s current attorney, Shaun Chase, had argued for the dismissal of this second indictment, alleging a violation of Ashley’s right to testify in grand jury proceedings, according to reporting by The Citizen.
