Seneca County District Attorney Mark Sinkiewicz told the Finger Lakes Times that the delay came after the defense was presented with fresh discovery materials, largely obtained by the prosecution only the previous week.

The court is currently in the process of determining a new trial date.

Waugh, a Texas inhabitant and previous Waterloo resident visiting for a wedding, was shot and killed on Route 96 in Waterloo last September.

Both Ellison, represented by Lawrence Kasperek, and Kesterson, represented by Manford Susman, are currently detained at the Seneca County Correctional Facility awaiting the rescheduled trial.
