Gage Ashley, 25, is set for a second trial on murder charges related to the 2019 fatal shooting of Joshua A. Poole, after an appeals court invalidated his previous conviction.
The retrial, reported by The Citizen this week, is slated for March 4, 2024.
Ashley’s initial conviction in December 2021 on charges including first-degree murder was overturned in May by the state Appellate Division, Fourth Department, due to the discovery that a grand jury member had a criminal conviction, rendering the grand jury unlawfully constituted.
The Cayuga County District Attorney’s Office is pressing ahead, charging Ashley again in June with the same offenses.
