Auburn man charged with murder again after previous conviction overturned

Gage Ashley, a 25-year-old Auburn resident whose murder conviction was previously overturned, was re-indicted and arraigned in Cayuga County Court on Thursday.


The Citizen reports that Judge Thomas Leone heard the case in which Ashley was charged with first-degree murder, second-degree murder, first-degree attempted robbery, and second-degree criminal possession of a weapon related to the 2019 death of 36-year-old Joshua A. Poole.

Ashley’s prior conviction was overturned in May 2023 by the state Appellate Division-Fourth Department, stating the grand jury in the original indictment was illegally constituted due to a juror’s criminal history.

Due to the manner in which the conviction was vacated – prosecutors were able to re-charge Ashley.
