Driver found guilty in double fatal Wayne County accident

The driver in a double-fatal accident has been found guilty on an array of charges in Wayne County.

The driver, Christopher M. Kirkey, 39, lost control of his vehicle, hitting a guard rail, bridge abutment, and subsequently overturning into Crusoe Creek.


Kirkey was treated at Upstate Medical for injuries sustained in the crash, while the two passengers, Kayla M. Mettler, 27, and Michael K. Schute, 32, were pronounced dead at the scene.

After several delays due to the impending COVID respiratory infection, Wayne County District Attorney, Michael D. Calarco, announced this week that Kirkey received maximum sentences for each conviction.


The jury found him guilty of all seven counts, including aggravated vehicular homicide; and two counts of second-degree manslaughter.

Under New York law, Judge Daniel Barrett sentenced Kirkey to between 8 1/2 to 25 years for the Aggravated Vehicular Homicide conviction, with the remaining sentences to run concurrently.
