A measure to expand on the wrongful death statute is currently on its way to Governor Kathy Hochul’s desk to be signed.
The new measure would let someone file a claim regarding wrongful death on the grounds of emotional suffering and anguish. Right now the law currently only covers financial losses surrounding someone’s death.
Not everyone supports this move. Doctors’ organizations, business groups and local governments have all asked Hochul to veto the bill because it would cause higher insurance premiums. Patients would then be forced to foot the bill.
Those supporting it believe it would greatly benefit grieving families. Many families that would benefit could be from low income communities.
