Do ‘no smoking’ policies apply to cannabis?

That question was posed to News10NBC who looked into the answer.

According to the state, the Clear Indoor Air Act prohibits smoking and vaping in almost all public and private indoor workspaces.


However, private residences or rental properties fall under separate guidance. In theory, an individual city, town, or village could have an ordinance outlining what is, or is not allowed on rental properties – this includes smoking marijuana. But it requires specific action.

In other words, if there is no policy – the state’s no smoking laws do not apply to cannabis.

If property owners want to ban specific things on rental properties – that’s up to them, and would require their own enforcement.
